Woman pleads not guilty to murder of 3-year-old Cleveland boy
CLEVELAND, Ohio (WOIO) - One of three adults charged in connection with the fatal shooting of a three-year-old Cleveland boy in the city’s Stockyards neighborhood was arraigned in Cuyahoga County Court of Common Pleas Wednesday.
Katherine Treadway pleaded not guilty to the charges of aggravated murder, murder, felonious assault, attempted murder, involuntary manslaughter, having weapons under disability, and discharging a firearm on or near prohibited premises.
The judge set Treadway’s bond at $500,000 and scheduled her pre-trial for Oct. 17.
Luis Diaz died after being struck by a stray bullet on Sept. 28.
According to Cuyahoga County Prosecutor Michael O’Malley, Treadway was arguing with a man outside of their duplex on W. 66th Street near Denison Avenue.
After the argument, she allegedly called her boyfriend, Juan Davis, and moved her vehicle out of the driveway.
A few minutes later, Davis drove to a nearby street and Devonte Parker and a 16-year-old boy exited the vehicle, said O’Malley.
Parker, armed with a handgun, and the teenager, armed with a rifle, ran towards the home and fired multiple shots from across the street, before fleeing.
One of the bullets struck the three-year-old boy, who was in a car seat in his mother’s car, and another struck the 31-year-old man Treadway had been arguing with.
Diaz died from his injuries at MetroHealth Medical Center.
The 31-year-old man, who was standing outside the car, was struck in the foot. He was treated at a local hospital.
Diaz’s 22-year-old mother and an 11-month-old sibling were also in the vehicle, but they were not injured.
Parker, 28, and Davis, Jr., 34, are scheduled to be arraigned in Cuyahoga County Court of Common Pleas on Thursday, Oct. 12.
They are also both charged with aggravated murder, murder, felonious assault, involuntary manslaughter, having weapons under disability, and discharging a firearm on or near prohibited premises.
The 16-year-old boy is being held at the Cuyahoga County Juvenile Detention Center and is scheduled back in court on Oct. 17.
